Freedom of Information

SMC Freedom of Information Policy

The Freedom of Information (Scotland) Act came into force on 1 January 2005. SMC is not currently included in the list of public authorities which are covered by the Act. As SMC is committed to transparency and accountability in the way we work, we have made a policy decision to act, so far as possible, within the spirit of the Act. It should be noted that the Scottish Information Commissioner has no remit over SMC in relation to Freedom of Information.

With this in mind, SMC will:

Review our business processes and amend where necessary
SMC has implemented a document management system to assist in the management of its information, and make it easier to respond to requests for information.
SMC is currently formulating a retention schedule for its records.
SMC has increased the amount and type of information available via its website.

Produce a publication scheme of SMC information
SMC has produced a publication scheme following consultation with its contacts and members of the public. This scheme is now available on the SMC website. The Scottish Information Commissioner has no power to approve or enforce this scheme.

Ensure that all SMC staff receive training regarding the Act
The Information Manager will be receiving in-depth training about implementing the Freedom of Information (Scotland) Act. Corporate training in Freedom of Information will be given to all other members of SMC staff.

Produce information on SMC�s policy in relation to Freedom of Information
SMC will keep members of the public informed about any policy decisions regarding Freedom of Information via the SMC website and the monthly SMC e-bulletin.
